ASSET PROTECTION ISN'T JUST FOR THE WEALTHY
The Cost of Waiting Can
Be Significant
Many Kentucky families assume asset protection is only necessary for high-net-worth individuals. The reality is that one extended nursing home stay, medical crisis, probate dispute, or creditor claim can dramatically reduce the wealth you've worked hard to build.
Without proper planning, your family may face:
- Nursing home costs consuming life savings
- Medicaid eligibility challenges
- Probate delays and court expenses
- Unnecessary taxes and administrative costs
- Loss of control over healthcare and financial decisions
- Reduced inheritance for loved ones
The earlier you plan, the more options you have.
OUR ASSET PROTECTION SERVICES
Comprehensive Strategies Designed
Around Your Goals
Estate Planning
Who will make your decisions if you cannot? Who will pay your bills? Who will take care of those you love? Ultimately, who will inherit your assets? These are the questions that a proper Kentucky estate plan answers for you.
Elder Law Planning
A step beyond basic estate planning, Kentucky elder law planning contemplates not just who will make your decisions if you cannot and who will inherit your estate at death but how you will protect your estate during life.
Medicaid Planning
Paying privately for home health care, assisted living facility care or skilled nursing facility care is expensive. Without proper planning and advice, paying for the high costs of long term care can easily wipe out a lifetime of savings.
Additional Services
We know that there are times when you or your loved ones may need additional legal services outside of Kentucky elder law planning.

FREQUENTLY ASKED QUESTIONS
Some Common Questions
What if I can’t come in to see you?
We understand that not everyone can come into our office. Unlike other firms we can make arrangements to come to you. Let us know when you call us at (502) 348-2108 to set an appointment or fill out our contact form below and we will contact you to coordinate a meeting based on your individual needs.
Can’t I just do estate planning?
Traditional estate planning addresses what happens to your assets after you pass away, but it does little to protect them during your lifetime. Asset protection and elder law planning go further — shielding your savings from long-term care costs, creditor claims, and Medicaid spend-down requirements while you are still here to benefit from them.
I’m already paying for long term care. Am I too late?
Not necessarily. Although advance planning offers more options, crisis-planning strategies may still preserve a meaningful portion of a person’s assets. Available options depend on marital status, income, property, prior transfers, healthcare needs, and timing.
My mom can’t make decisions anymore, what do I do?
If you have not signed appropriate powers of attorney, your family may need to ask a court to appoint a guardian or conservator. That process can be public, expensive, and time-consuming. Proper planning allows you to choose who will make financial and healthcare decisions for you.
Is it important your attorneys have litigation backgrounds?
Yes. Attorneys with litigation experience understand how plans are attacked in court — by creditors, by disgruntled family members, or by the state. That perspective shapes how we draft every trust and estate plan, so your documents are built to withstand challenges, not just sit in a drawer.
