ABOUT
Kentucky Asset Protection

Families work a lifetime to build something — a home, a nest egg, a business, a legacy for their children. What too few realize is how quickly a single unexpected event can put all of it at risk. One extended nursing home stay, a medical crisis, a probate dispute, or a creditor claim can undo decades of careful saving. Kentucky Asset Protection exists to make sure that doesn’t happen to your family.
We’re a Bardstown-based law firm focused on estate planning, elder law, and Medicaid planning for individuals, families, retirees, and business owners across Central Kentucky. Led by attorney S. Thomas Hamilton, we help clients create customized legal strategies that protect their wealth, qualify them for benefits when they need care, and preserve their legacies for the next generation. This isn’t a sideline for us — it’s the whole of what we do, and we do it every day.
If you’ve been putting off this kind of planning because it feels overwhelming or unpleasant to think about, you’re not alone. Our job is to make it manageable. Request a consultation and we’ll walk through it together, at your pace.
REASONS
Why We Do This Work
There’s a common assumption that asset protection is only for the wealthy. In our experience, the opposite is true — it’s often middle-class families who have the most to lose, because they’ve saved carefully but don’t have enough to simply absorb the cost of long-term care out of pocket. When an extended nursing home stay in Kentucky can run well into six figures a year, the family farm, the paid-off house, and the retirement account that was meant to last are all suddenly on the line.
We built this practice because families in that position deserve someone in their corner who actually understands the system — not a general practitioner who dabbles in wills, but a firm that concentrates on elder law and knows how Kentucky’s Medicaid, probate, and estate rules interact. The earlier a family plans, the more we can protect. But even when someone comes to us in the middle of a crisis, there is almost always something meaningful we can do. That belief — that it’s rarely too late to help — is at the heart of the practice.

MEET
S. Thomas Hamilton
Attorney S. Thomas Hamilton leads Kentucky Asset Protection, the elder law and asset protection practice of Thomas Hamilton, PSC. A Kentucky native, Thomas earned his bachelor’s degree from Transylvania University in 2006, where he studied Political Science and Spanish, before going on to earn his Juris Doctor from the University of Kentucky College of Law in 2010. He was admitted to the Kentucky Bar in 2011 and has practiced in the Commonwealth ever since.
Thomas began his legal career in the courtroom, serving as an Assistant Commonwealth Attorney for the 10th Judicial Circuit, where he prosecuted felony cases across Nelson, Hart, and LaRue Counties. That trial experience continues to shape how he approaches planning today: he builds estate and elder law plans designed to hold up if they are ever challenged, not simply to look complete on paper. Clients who come to him with a dispute already brewing benefit from an attorney who has spent real time in a courtroom.
Today Thomas focuses his practice on elder law, estate planning, Medicaid planning, and asset protection. He is a member of the National Academy of Elder Law Attorneys (NAELA), ElderCounsel, and the Academy of Special Needs Planners (ASNP), organizations that keep him current in a field where the rules change often. He also stays active in the Bardstown community, including through the Kiwanis Club of Bardstown.
What clients tend to remember, though, isn’t the résumé — it’s the way he explains things. Thomas has a talent for taking genuinely complicated law and making it understandable, so families can make confident decisions instead of anxious guesses. He and his family are proud to call the Bardstown area home, and that local connection shows in the way he treats the people he serves.
WHY FAMILIES CHOOSE KENTUCKY ASSET PROTECTION
Our Approach
Every family that walks through our door is different, and we build our work around that reality. Four principles guide how we serve clients.
Expertise
Our firm brings in-depth knowledge of Kentucky’s Medicaid laws and regulations, so the plans we build are made to hold up in practice — not just to look complete on paper. In an area where the rules shift often and a small error can be costly, that depth matters.
Personalized Approach:
We take the time to listen. Before we recommend anything, we want to understand your concerns, your goals, and your family’s specific situation, then craft a plan that fits you rather than handing you a one-size-fits-all template.
Comprehensive Solutions:
From asset protection strategies to guiding you through the Medicaid application process, we handle the full picture. You shouldn’t have to stitch together advice from three different professionals — we coordinate it so you have peace of mind.
Local Knowledge:
As a firm rooted in Bardstown, we understand the Central Kentucky healthcare landscape and the community our clients live in. That local grounding lets us offer guidance that’s specific and practical, not generic.

FREQUENTLY ASKED QUESTIONS
Some Common Questions
What happens during an initial consultation?
We review your family circumstances, health concerns, assets, income, existing documents, and goals. We then identify planning options, explain their advantages and limitations, and recommend an appropriate course of action.
What should I bring to my first consultation?
Helpful information includes current estate-planning documents, deeds, account statements, beneficiary designations, insurance information, a general list of assets and debts, and information about family members or intended beneficiaries. For a crisis consultation, recent financial and nursing-facility records are particularly important.
Do you only help wealthy families?
No. Long-term-care expenses can quickly affect a family of moderate means. Planning can be especially important when a person’s primary assets are a home, farmland, a family business, or savings intended to support a spouse.
